Grounds for Divorce in NC
- Separation ~No Fault: Living separate and apart for one year with the intent to be divorced (at least one spouse with no plans to reconcile).
- Incurable insanity
You may also file for a Legal Separation (divorce from bed and board)
- Abandonment
- A spouse maliciously turning the other out of doors
- A spouses cruel or barbarous treatment that endangers the life of the other
- A spouse offering such indignities to the person of the other as to render his/her life condition intolerable and life burdensome (mental cruelty)
- A spouse becoming an abuser of alcohol or drugs so as to render the condition of the other spouse intolerable and their life burdensome
- Adultery

Benefits of creating a separation agreement in mediation prior to divorce
- When you create your agreement in the mediation process, convert it into your legal agreement, and have both of your signatures notarized, it is a legal and binding contract. ~ This means that all issues have been resolved prior to divorce and you will not loose your opportunity to claim equitable distribution of marital assets and spousal support as you would if you finalized your divorce before resolving these issues ~
- You hash out the issues in an environment conducive to collaboration and privacy. The mediators goal is to help you towards an amicable agreement you both can feel comfortable with as quickly as possible.
- You both are in the same room together when decisions are made
- You pay one hourly rate between the two of you as apposed to you both paying two separate lawyer fees for the "back & forth" of negotiations which gets extremely expensive
- Once your agreement is finished, the services you need from your lawyer are far less expensive
